I wouldn't have a problem with it but anyone doing so would do it at their own risk. We wouldn't be liable for their ipod being broken or any other mishaps.
For those not knowing what a jailbroken iPod is:

Basically, if you jail brake an ipod touch, it is software that you put on your ipod that allows you to change default apple settings like the menue screen, and add non webapp games (aka dowlad software that you dont need the internet to use)
If the ipod toch has an error, or is some how broken (not physicaly) while the ipod is jail broken, the warranty is voided
Do it at your own risk. Be aware though that the iPhone/iPod touch's SDK (software Development Kit) will be coming out very soon. This will allow developer to create really cool applications and Apple will allow you to put these on your iPod, through iTunes and will not void any warranty or 'brick' your iPod.
I can't tell you if Apple are going to charge for the applications or when the SDK will come out as i am not allowed to give you such information but this is better than jailbreaking
